Sharia Compliance

Last Updated: August 28, 2024

Halal Market & Trade is committed to maintaining a marketplace that aligns with the principles of Sharia (Islamic law) as understood by Ahl as-Sunnah wa’l-Jamaa‘ah and the followers of the righteous early generations of Islam (as-salaf as-saalih). This Sharia Compliance Policy outlines our stance on the types of listings allowed on our platform and the actions we may take if listings violate these guidelines.

1. Prohibited Content

We strictly prohibit the promotion or listing of items, services, or content that include any haram (forbidden) elements as determined by the teachings of Salafi scholars and in alignment with the broader principles of the four major Sunni madhabs. This includes, but is not limited to:

    • Tobacco Products: Cigarettes, cigars, vaping products, and any other tobacco-related items.
    • Music and Entertainment: Music and forms of entertainment that are not permissible in Islam, including those with inappropriate content or themes.
    • Adult Entertainment: Any form of adult content, including pornography, explicit materials, and services related to adult entertainment.
    • Gambling and Games of Chance: Casinos, betting services, lotteries, and any other forms of gambling.
    • Alcohol: Beer, wine, spirits, and any other alcoholic beverages.
    • Drugs and Narcotics: Illegal drugs, controlled substances, and any items related to the sale or promotion of drug use.
    • Usury (Riba): Listings related to interest-based financial services, loans, or any business models involving usury.
    • Haram Foods: Pork, non-halal meat, and other foods not slaughtered or prepared according to Islamic guidelines.
    • Non-Compliant Clothing: Clothing items that do not adhere to Islamic dress codes, including immodest or revealing apparel.
    • Profane and Offensive Content: Any content that includes offensive language, blasphemy, or speech that contradicts Islamic values.
    • Horoscopes, Sihr (Magic), and Fortune Telling: Listings related to astrology, magic, divination, or any forms of fortune-telling.
    • Weapons and Violence: Items that promote violence, including weapons and militaristic gear not meant for self-defense within legal bounds.
    • Financial Speculation and High-Risk Investments: Any schemes involving speculation, including trading in cryptocurrencies, forex without proper Sharia compliance, or other high-risk financial products.
    • Mixing of Opposite Genders in an Un-Islamic Manner: Listings that promote events, services, or gatherings where improper mixing of genders occurs, contrary to Islamic guidelines.
    • Theft and Fraud: Any listings that involve stolen goods, fraudulent activities, or misrepresentation of products or services.
    • Selling Items Not Owned: Listings for items or services that the seller does not own or have the legal right to sell, including fraudulent claims of ownership.
    • Deception in Business Transactions: Any form of deceit, including false advertising, misrepresentation of goods or services, or hiding defects to mislead buyers.
    • Bribery and Corruption: Any listings that involve bribery, corruption, or unethical business practices that are against Islamic teachings.
    • Monopolistic Practices: Listings or business models that involve hoarding, unfairly restricting supply, or other monopolistic behaviors that harm fair trade.
    • Misuse of Trust (Amanah): Breach of trust in business dealings, including not fulfilling contracts or agreements honestly and reliably.
    • Exploitation and Oppression: Listings that involve exploitation of workers, unfair wages, or any form of oppression contrary to the principles of justice and fairness in Islam.

2. Compliance with Local and National Laws

In addition to adhering to Sharia principles, all listings must comply with the laws and regulations of both the visitor’s country and Bosnia and Herzegovina, where our company is based. Any items or services that are illegal in these jurisdictions are strictly prohibited.

3. Right to Remove Listings

Halal Market & Trade reserves the right to remove any listing that includes or promotes haram elements or that violates local, national, or Islamic laws. We will notify the user prior to the removal of the listing, providing the reason for the removal and, if possible, suggesting steps to correct the issue.

4. User Responsibility

Users are responsible for ensuring that their listings comply with this Sharia Compliance Policy and the broader Terms of Service of Halal Market & Trade. We encourage users to review their content carefully and to avoid submitting any listings that could violate these guidelines.

5. Reporting Violations

We encourage our community to report any listings they believe violate this policy. Reports can be made through our contact email at info@halalmarket.online. We will review all reports and take appropriate action as necessary.

6. Policy Updates

We may update this Sharia Compliance Policy from time to time to reflect changes in our practices, Sharia interpretations, or for other operational, legal, or regulatory reasons. Any changes will be posted on this page with an updated “Last Updated” date. Your continued use of the Website after any changes indicates your acceptance of the updated policy.

8. Basis of Compliance

Our Sharia Compliance Policy promotes the ‘aqeedah (beliefs) of Ahl as-Sunnah wa’l-Jamaa‘ah and the followers of the righteous early generations of Islam (as-salaf as-saalih). We strive to ensure that our compliance and rulings are based on evidence from the Holy Qur’an and the soundly-narrated (saheeh) prophetic Sunnah. Our guidelines are drawn from the writings of scholars, including the imams of the four major Sunni madhabs—Imam Abu Haneefah, Imam Maalik, Imam ash-Shaafa‘i, and Imam Ahmad ibn Hanbal—as well as other early and later scholars. We also consider statements from fiqh councils and seekers of knowledge who conduct research in various Islamic specialties.
